Civil Cases in Bell, Coryell and McLennan Counties
Frank handles civil cases in the state courts of Bell, Coryell and McLennan counties and in federal court in the Western District of Texas. Depending on the amount in dispute, a civil case in Bell County may be heard in a justice court, a county court at law or a district court in Belton. Smaller disputes can sometimes be resolved quickly in justice court, where the limit is $20,000, while larger cases go to county or district court.
How a Civil Case Moves Forward
Most civil cases start with a demand letter and an effort to settle before a lawsuit is filed. If the case does not settle, a petition is filed and served on the other side, and both sides exchange documents and information in a process called discovery. Many Central Texas courts require mediation before trial, where a neutral mediator helps the parties try to reach an agreement.
Frank will give you an honest assessment of the strengths and weaknesses of your case, the likely costs and how long it may take, so you can make informed decisions at each step.
Civil Law Questions and Answers
How long do I have to file a lawsuit in Texas?
It depends on the type of case. Many personal injury, medical malpractice and products liability claims must be filed within two years, while many breach-of-contract claims have four years. Some deadlines are shorter, so it is important to act quickly.
What is special about medical malpractice cases in Texas?
Texas requires written notice to the health care provider at least 60 days before filing suit, and an expert report early in the case. The law also caps some types of damages. These cases need careful preparation from the start.
Do I have a products liability case?
If a defective product caused an injury, you may have a claim against the manufacturer or seller. Keep the product and its packaging, and do not repair or throw it away.
How are legal fees handled in civil cases?
It depends on the case. Personal injury and some other cases may be handled on a contingency fee, meaning the fee comes from any recovery. Business disputes are often billed differently. Frank will explain the fee arrangement before you decide.
Does Frank handle family law cases?
No. The firm does not handle divorce, custody or other family law matters, but we are glad to point you to other resources.
