A car accident is stressful and confusing, and it is easy to forget important steps in the moment. What you do in the minutes, days, and weeks afterward can make a real difference in your health and in any injury claim. Here is a practical checklist.

At the Scene

  1. Check for injuries and call 911. If anyone is hurt, get medical help right away. Ask for police to come to the scene so an official crash report is made.
  2. Move to safety if you can. If the vehicles can be moved and no one is seriously hurt, move out of traffic and turn on your hazard lights.
  3. Exchange information. Texas law requires drivers involved in a crash to exchange names, addresses, vehicle registration, and insurance information. Get the other driver’s license plate number and insurance company.
  4. Take photos and video. Photograph all vehicles, the damage, the road, traffic signs, skid marks, weather conditions, and any visible injuries.
  5. Talk to witnesses. Get names and phone numbers of anyone who saw what happened. Witnesses can be hard to find later.
  6. Be careful what you say. Stick to the facts with police and the other driver. Avoid apologizing or guessing about what caused the crash.

In the Days After the Accident

  • See a doctor, even if you feel okay. Some injuries, such as whiplash, concussions, and back injuries, may not show symptoms right away. A prompt medical visit protects your health and documents your injuries.
  • Get the crash report. Texas crash reports can usually be purchased online through the Texas Department of Transportation once they are available.
  • Notify your insurance company. Report the accident as your policy requires, but be cautious about giving a recorded statement to the other driver’s insurer before talking with a lawyer.
  • Keep records. Save medical bills, receipts, repair estimates, and proof of missed work. Keep a simple journal of your pain, limitations, and appointments.
  • Stay off social media. Avoid posting about the accident or your injuries.

Don’t Wait Too Long

Most personal injury claims in Texas must be filed within two years of the accident, and claims involving a city, county, or state vehicle can require written notice within six months or less. Evidence such as video footage and witness memories also fades quickly, so it helps to get advice early. To learn more about dealing with insurers, read how insurance companies handle injury claims.
